These Terms of Use apply to the Form & Verity website at formandverity.com, and to the educational courses, training, and resources Form & Verity offers.

Course access and enrollment are delivered through a separate learning platform at learn.formandverity.com. Additional terms presented at registration or checkout may also apply to a specific offering.

1. Acceptance of Terms

By accessing or using Form & Verity websites, content, courses, resources, or services, you agree to these Terms of Use and to any additional terms presented for a specific offering. If you do not agree, please do not use the site or purchase our offerings.

2. About Form & Verity

Form & Verity provides educational courses, training, resources, and related educational content for families and for professionals. It is an education and training brand; it is not a counseling practice, and this website does not provide clinical services.

Form & Verity is an educational brand operated by Andrew Simmons Counseling, PLLC.

For purposes of these Terms, references to “Form & Verity,” “we,” “us,” or “our” may refer to Andrew Simmons Counseling, PLLC operating through the Form & Verity educational brand, where the context requires identification of the legal operator.

3. Educational Purpose Only

Form & Verity content is provided for educational and informational purposes. It is not individualized:

  • mental health treatment or psychotherapy
  • medical advice
  • legal advice
  • financial advice
  • emergency or crisis services

Andrew Simmons, LPC-S is a licensed professional counselor and clinical supervisor, and his professional experience informs the material. Even so, purchasing or using educational content does not by itself create a therapist-client, counselor-client, physician-patient, attorney-client, supervisory, or other professional treatment relationship with Andrew Simmons, Form & Verity, Elevate Counseling Group, instructors, contributors, or affiliates.

If you or someone else is in immediate danger or experiencing a crisis, contact local emergency services or an appropriate crisis line rather than relying on educational material.

4. Professional Education

Professional training and continuing education offerings are educational in nature. They do not supervise, direct, or substitute for your own professional judgment. Professionals remain responsible for:

  • practicing within their own scope of practice and competence
  • complying with applicable laws, rules, and ethical standards
  • exercising independent professional judgment
  • determining whether a particular course satisfies requirements applicable to their license, jurisdiction, employer, board, or credential

Form & Verity does not represent that any offering is accepted for continuing education credit in every jurisdiction or by every board, employer, or credentialing body. Any approval status that applies to a specific program is stated on that program's own materials.

5. Accounts

Some offerings require an account on the separate learning platform. If you create an account, you are responsible for:

  • providing accurate registration information
  • maintaining the security of your account credentials
  • activity that occurs through your credentials
  • promptly reporting suspected unauthorized access

6. Eligibility and Minors

Our offerings are intended to be purchased and managed by adults. Parent education discusses children and adolescents, but children are not intended purchasers or account holders unless a specific offering expressly provides for it.

Please do not submit sensitive personal information about a child through the general contact form.

7. Purchases and Payment

Paid offerings may be purchased through third-party payment processors. Prices, what is included, and any purchase terms specific to an offering are presented at checkout. Payment details you enter are handled by the payment processor under its own terms and privacy practices; Form & Verity does not store complete payment card numbers.

8. Refunds

Refund eligibility is governed by the Refund Policy applicable at the time of purchase. These Terms do not create separate or conflicting refund terms.

9. License to Course Materials

When you purchase a course, you receive a limited, personal, non-exclusive, non-transferable license to access and use the materials for your own educational purposes. Unless expressly permitted, you may not:

  • reproduce, republish, or resell the materials
  • distribute or upload the materials publicly
  • share account access with others
  • systematically download or copy course content
  • create competing course or training materials substantially derived from Form & Verity content

Ordinary personal use is welcome, including viewing, taking notes, and printing or downloading worksheets and resources that are made available for that purpose. Professionals may use ideas they learn in their own practice; the restrictions above apply to our materials themselves.

10. Intellectual Property

Original course materials, videos, worksheets, assessments, graphics, branding, and site copy are protected by applicable intellectual property laws. Third-party materials, names, and trademarks referenced in our content remain the property of their respective owners, and nothing here claims rights in them.

11. Acceptable Use

Please do not:

  • use the site or content for unlawful purposes
  • attempt unauthorized access to accounts, systems, or data
  • interfere with the operation of the site or platform
  • introduce malicious code
  • scrape or harvest content at scale
  • circumvent access controls or share credentials
  • make fraudulent purchases or impersonate others
  • use our content in a way that violates the rights of others

12. Third-Party Services and Links

Form & Verity uses and links to third-party services, which may include hosting providers, payment processors, authentication providers, video hosting, email delivery, and outside resources referenced in our content. We do not control those services or websites, and their own terms and privacy policies apply to your use of them.

13. No Guarantee of Results

Educational outcomes vary with circumstances, effort, and factors outside our control. Form & Verity does not guarantee parenting outcomes, a child's behavior, clinical outcomes, professional advancement, licensure, continuing education acceptance in every jurisdiction, financial or business results, or any particular result from applying educational content.

14. Availability and Changes

We may maintain, modify, update, replace, or discontinue website features and course content, and site availability may be interrupted from time to time. This provision does not reduce any specific access commitment made for an offering at the time of purchase; where those commitments and this section differ, the terms presented at checkout for that offering control.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free. Nothing in this section limits any warranty or right that cannot lawfully be excluded or limited.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Form & Verity and its owners, instructors, contributors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the website, content, or courses. To the fullest extent permitted by applicable law, our total liability for any claim relating to an offering will not exceed the amount you paid for that offering. Some jurisdictions do not allow certain limitations, and this section does not exclude liability that cannot lawfully be excluded.

17. Indemnification

You agree to indemnify and hold harmless Form & Verity and its owners, instructors, contributors, and affiliates from third-party claims, damages, and reasonable costs arising from your misuse of the website or services, your violation of these Terms, or your infringement of another party's rights.

18. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, except where applicable law requires otherwise.

19. Severability

If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Waiver

Our failure to enforce a provision of these Terms is not a waiver of that provision or of any other provision.

21. Changes to These Terms

We may update these Terms and will post the revised version here with a new Last Updated date. Where applicable law requires your affirmative consent to a change, we will seek that consent rather than treating continued use as agreement.
